1. Service Agreement

1.1 Scope of Services

Terra Maintenance provides professional grounds maintenance services including but not limited to: mowing services (regular, one-time, slashing, acreage), hedge services (trimming and reduction), hard surface services (cleaning and sealing), tree services (pruning and removal), weed management, mulching, and overgrowth management.

1.2 Service Estimates

All estimates are based on the information you provide. Final pricing may vary if site conditions differ from the initial assessment. We will notify you of any significant price variations before commencing work.

1.3 Service Scheduling

We will make every reasonable effort to attend at the scheduled time. Weather conditions, equipment issues, or unforeseen circumstances may require rescheduling. We will notify you as soon as possible if a rescheduling is necessary.

2. Payment Terms

2.1 Payment Methods

We accept payment via bank transfer, credit card, or cash. Payment details will be provided in your estimate or invoice.

2.2 Payment Terms

• One-Time Services: Payment is due upon completion of service unless otherwise agreed
• Regular Services: Payment terms will be specified in your service agreement (typically monthly in arrears)
• Large Projects: May require a deposit before commencement

2.3 Late Payments

Invoices are due within 14 days of issue unless otherwise specified. Late payments may incur a fee and may result in suspension of services until the account is brought current.

3. Cancellation and Rescheduling

3.1 Customer Cancellations

• One-Time Services: Cancellations with less than 24 hours notice may incur a $50 cancellation fee
• Regular Services: 14 days written notice required to cancel ongoing service agreements
• Rescheduling: Free rescheduling with 24 hours notice; late changes may incur fees

3.2 Our Cancellations

We reserve the right to cancel or reschedule services due to weather, equipment failure, safety concerns, or other unforeseen circumstances. No fees will be charged for cancellations initiated by us.

4. Property Access and Conditions

4.1 Access Requirements

You agree to provide safe and unobstructed access to the service area. This includes:

• Clear access to gates, driveways, and work areas
• Notification of any hazards (underground services, irrigation systems, etc.)
• Securing pets during service visits
• Removal of any items that may obstruct service delivery

4.2 Property Damage

We take great care to avoid property damage. If damage occurs due to our negligence, we will work with you to remedy the situation. You must notify us of any damage within 48 hours of service completion.

5. Warranties and Guarantees

5.1 Service Quality

We guarantee professional service delivery using qualified personnel and well-maintained equipment. If you are not satisfied with our service, please contact us within 48 hours and we will make it right.

5.2 Limitation of Warranties

We do not guarantee specific results for organic materials (grass growth, plant health, etc.) as these are subject to weather, soil conditions, and other factors beyond our control.

6. Liability Limitations

6.1 Insurance Coverage

Terra Maintenance maintains comprehensive public liability insurance and workers compensation insurance. Our liability is limited to the extent permitted by law and covered by our insurance policies.

6.2 Exclusions

We are not liable for:

• Pre-existing damage to property
• Damage to unmarked underground services (irrigation, cables, etc.)
• Damage caused by following customer instructions
• Natural events or acts of God
• Consequential or indirect damages

7. Health and Safety

We are committed to maintaining a safe work environment. We comply with all relevant health and safety legislation including WorkSafe Victoria requirements. You agree to notify us of any hazards on your property that may affect our team's safety.

8. Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of Terra Maintenance or our licensors and is protected by copyright and trademark laws. You may not use, reproduce, or distribute any content without our prior written permission.

9. Dispute Resolution

9.1 Informal Resolution

In the event of any dispute, we encourage you to contact us first to seek an informal resolution. Most concerns can be resolved through direct communication.

9.2 Formal Dispute Process

If an informal resolution cannot be reached, disputes will be handled in accordance with Australian Consumer Law and may be referred to mediation or arbitration before legal proceedings.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Terra Maintenance regarding our services.
